Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of X3JS, a platform operated by Miramtech, established in Türkiye ("X3JS", "we", "us" or "our"), for creating, publishing, playing and sharing interactive 3D creations, games and experiences (the "Service"). By creating an account or using the Service you agree to these Terms, to our Privacy Policy, and to the policies referenced here, including our Copyright Policy. If you do not agree, do not use the Service.

Eligibility and Age

You must be at least 13 years old to use the Service. Where the age of digital consent in your country is higher, you must meet that age. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. By using the Service you confirm that you meet these requirements.

Your Account

To use most features you must create an account with accurate information that you keep up to date. You are responsible for safeguarding your password and for all activity under your account, and you must notify us promptly at contact@miramtech.com if you suspect unauthorised use. We may reclaim usernames and may refuse or revoke registration at our discretion.

Your Content and Creations

You keep ownership of the content and creations you make or upload ("Your Content"). You are solely responsible for Your Content and must have all rights necessary to share it — in particular, do not upload 3D models, textures, audio or other assets you do not have the right to use.

By publishing Your Content, you grant X3JS a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, adapt and create derivative works of it as needed to operate, promote and improve the Service. This licence ends when you remove Your Content, except for backups, copies retained for legal or safety reasons, and content that other users have already shared, embedded or built upon.

You represent that Your Content does not infringe the rights of others and does not violate these Terms.

Sharing, Forking and Remixing

X3JS is built around reuse. If you publish a creation or kit and mark it as forkable, remixable or otherwise reusable, you grant every other user of the Service a non-exclusive, royalty-free licence to use, copy, modify and build upon it within the Service, and to publish their own derivatives, subject to these Terms. Derivatives that others have already created may remain available even after you remove your original. If you do not want your work reused, do not publish it as reusable.

Kits and User Code

Kits and certain creations contain code that runs in other users' browsers. This carries special responsibilities:

• If you publish a kit or code, you warrant that it is your own or properly licensed, that it does not contain malware, miners, trackers or data-exfiltration logic, and that it does not attempt to break out of, disable or abuse the Service's sandbox or security.
• If you run a kit or creation made by someone else, you do so at your own risk. We apply sandboxing and other safeguards, but we do not review all code and cannot guarantee that any kit is safe, functional or free of harmful behaviour.
• We may remove, disable or restrict any kit or code at any time, including to protect users or the Service.

Acceptable Use and Community Rules

These rules apply to everyone. When using the Service, you agree not to:

• break the law or infringe the intellectual property, privacy or other rights of others;
• upload or share content that is unlawful, harassing, hateful, defamatory, or sexually exploitative of minors, or that depicts or facilitates serious harm;
• publish malicious code, attempt to circumvent the sandbox or security, or disrupt, overload or gain unauthorised access to the Service;
• cheat, exploit bugs for unfair advantage, or interfere with other users' experience;
• scrape, harvest or bulk-collect content or data except as expressly permitted;
• impersonate any person or entity, or misrepresent your affiliation;
• send spam or unsolicited communications, or run schemes involving cryptocurrency, tokens or deceptive monetisation;
• misuse direct messages to harass, threaten or distribute prohibited content.

We may remove content and suspend or terminate accounts that break these rules. We do not pre-screen most content, but we may review and act on it.

Our Intellectual Property

The Service itself — including its software, editor, engine, documentation, AI guides, design, logos and the "X3JS" name — is owned by Miramtech and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, these Terms transfer no ownership in the Service. You may not copy, modify, distribute, reverse engineer or create derivative works of the Service except as permitted by these Terms or applicable law.

Copyright and Takedowns

We respect intellectual property and expect you to do the same. If you believe content on the Service infringes your copyright, you can ask us to remove it through the process in our Copyright Policy, which also explains counter-notices. We terminate the accounts of repeat infringers.

AI Features

If you use AI features, including connecting your own AI assistant, you remain responsible for the prompts you submit and the content you generate, and you must comply with these Terms and the AI provider's terms. AI output may be inaccurate or unoriginal, and you are responsible for reviewing it. See our Privacy Policy for how data is handled.

Third-Party Content and Services

The Service includes content created by other users and links to or integrations with third-party services. We do not endorse and are not responsible for third-party or user content, and your use of any third-party service is subject to that party's terms. Content created by other users belongs to them.

Active Development and Changes to the Service

X3JS is under active development. We may add, change, suspend or remove features at any time, and parts of the Service may be experimental, change without notice, or occasionally lose data. The Service is provided on an evolving basis, and you should not rely on any particular feature remaining available.

Automation and Programmatic Access

The Service may allow connected clients and programmatic access, for example through the connect / MCP flow. You must use such access in line with these Terms and any documented limits, must not exceed reasonable rate limits or place undue load on the Service, and must not resell or provide unauthorised access to others.

The documentation and guides the Service gives to AI assistants — through the connect / MCP flow or the AI entrance — are licensed to you only for building on X3JS. You may not copy, collect, publish or use them, in whole or in part, to build, train or improve another product or service.

Paid Features and Virtual Items

The Service is currently free to use. We may introduce paid features, a marketplace or creator monetisation in the future; when we do, additional terms will apply and will be presented to you before you use them. Any virtual items, credits or in-platform value have no real-world monetary value and are not redeemable for cash except where required by law.

Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. On termination, the licences you granted for content others have already used or built upon, and provisions that by their nature survive — such as ownership, disclaimers, limitation of liability and governing law — continue to apply.

Disclaimers

The Service and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that any kit or creation is safe, or that any content is accurate or reliable. You use the Service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, X3JS and Miramtech will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or content, arising out of or relating to your use of, or inability to use, the Service, including harm caused by user content or kits. To the extent liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred (100) US dollars. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer.

Indemnification

You agree to indemnify and hold harmless X3JS, Miramtech and their officers, employees and partners from any claims, damages, liabilities and expenses, including reasonable legal fees, arising out of Your Content, your kits or code, your use of the Service, or your breach of these Terms or the rights of others.

Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of Türkiye will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory law — such as consumer-protection law in your country of residence — gives you the right to bring proceedings, or requires a dispute to be heard, elsewhere.

Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect means you accept the revised Terms.
